1. Acceptance of Terms
By accessing or using the Provost Home Design website, purchasing house plans, or engaging with our services, you agree to be bound by these Terms & Conditions. If you do not agree, you must discontinue use of our website and services.
2. Intellectual Property
All content—including house plans, CAD drawings, images, text, and logos—is the property of Provost Home Design and protected by copyright and other laws. You may not reproduce, distribute, modify, or resell our plans without express written consent.
3. Use of Services
Purchased plans are licensed (not sold) for your personal project as described below. Modifications may be requested, but resale or redistribution of original or modified plans is prohibited.
4. User Obligations
You are responsible for ensuring plans comply with local building codes, zoning regulations, HOA/ARC rules, site conditions, and utilities. Consult a licensed architect/engineer and qualified builder before construction and for permit submittals where required.
5. Payment & Refunds
All sales are final. Due to the digital nature of plans, refunds are not offered. If there is an issue with your order, please contact us.
6. Limitation of Liability
To the maximum extent permitted by law, Provost Home Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or use, arising from the use or misuse of our plans. Construction is undertaken at your own risk.
7. Third-Party Links
Our site may link to third-party websites. We are not responsible for their content or practices. Accessing third-party resources is at your own discretion and subject to their terms and policies.
8. Privacy & Data Use
Your use of our site is also governed by our Privacy Policy. By using our site, you consent to the collection and use of your information as outlined there.
9. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules. Venue lies in the state or federal courts within Massachusetts.
10. Changes to These Terms
We may update these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the site after changes constitutes acceptance of the revised Terms.

12. Plan License (Single-Use, Non-Transferable)
- Single-use license: A purchase grants you (and your builder) the right to construct one (1) home from the plan.
- Non-transferable: You may not transfer, sublicense, sell, or give the plan files to another person or entity.
- Copies: You may print/reproduce copies reasonably necessary for bidding, permitting, and constructing the single licensed build.
- Multiple builds require additional licenses.
13. Prohibited Uses
- Resale, redistribution, or public posting of digital plan files.
- Using plans (original or modified) to create derivative works for resale or catalog distribution.
- Constructing more than one home without purchasing additional licenses.
- Removing or altering copyright notices.
14. Local Codes, Engineering & Permits
Plans may require review, adaptation, and stamping by a licensed professional in your jurisdiction. Site-specific factors (soil, wind, seismic, snow, energy code, floodplain, etc.) vary by location.
- Engineer/Architect of Record: You are responsible for retaining local professionals when required.
- Code compliance: You are responsible for verifying and achieving compliance with all applicable codes and ordinances.
- Field conditions: Contractor is responsible for means, methods, and verifying all dimensions and conditions prior to construction.
15. Dimensions, Materials & Variations
Dimensions shown may be nominal; verify in field and on final permit set. Materials and products illustrated may be substituted by your builder or dictated by local availability. As-built conditions may vary from drawings.
16. Deliverables & Timelines
Unless otherwise stated, plans are delivered as digital files. Typical timelines for modifications or custom work are estimates only and may change based on scope, revisions, and workload. We will communicate updates as needed.
17. Modifications & Custom Work
We offer plan modifications and custom design services. Fees, deliverables, and schedules will be confirmed in writing. You are responsible for final review/approval prior to permit submittal and construction.
18. Pricing, Taxes & Payment
Prices are subject to change without notice. Applicable taxes or processing fees may apply and will be shown at checkout or invoicing. Orders may be canceled by us for suspected fraud or misuse (with a refund where applicable).
19. Returns, Exchanges & Cancellations
Due to the nature of digital goods, we generally cannot accept returns or exchanges. If files are defective or a download fails, we will make reasonable efforts to correct the issue or re-deliver the files.
20. Disclaimers
Plans and content are provided “as is” without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not provide legal, engineering, or surveying services, and nothing on this site constitutes professional advice.
21. Liability Cap
In no event will our aggregate liability exceed the amount you paid to us for the applicable plan or service giving rise to the claim.
22. Indemnification
You agree to defend, indemnify, and hold harmless Provost Home Design from and against claims, damages, liabilities, costs, and expenses arising out of your use of the plans or breach of these Terms.
23. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, labor disputes, supply issues, or interruptions of internet/hosting services.
24. Miscellaneous
- Severability: If any provision is unenforceable, the remainder remains in effect.
- No waiver: Our failure to enforce a provision is not a waiver.
- Assignment: You may not assign these Terms without our consent.
- Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement regarding your use of our site and plans.
